GENERAL TERMS AND CONDITIONS OF SALE (GTC)

Article 1 - Scope of Application

These General Terms and Conditions of Sale (hereinafter "GTC") apply, without restriction or reservation, to all sales concluded by the sole proprietorship The Chair Atelier (hereinafter "the Seller") to non-professional buyers (hereinafter "the Client"), wishing to purchase chairs and furniture items offered for sale on the website [Your website URL] (hereinafter "the Site").

These GTC are accessible at any time on the Site and shall prevail over any other document. The Client declares to have read and accepted them by ticking the box provided for this purpose before validating their online order.

Article 3 - Products and Prices

The products offered for sale are chairs and furniture described and presented with the greatest possible accuracy on the Site. Due to the nature of the materials (wood, fabrics, etc.), slight variations in shades or finishes may exist and cannot engage the Seller's responsibility. The photographs are intended to be as faithful as possible but are not contractual.

The prices of our products are indicated in Euros (€), excluding taxes (HT), "VAT not applicable, article 293 B of the CGI".

They do not include shipping, transport and delivery costs, which are calculated according to the weight/volume of the order and clearly indicated before final validation. The Seller reserves the right to modify its prices at any time, but products will be invoiced on the basis of the rates in force at the time the order is placed.

Article 4 - Orders and Payment

The Client selects the chairs they wish to order on the Site, adds them to their basket, validates their delivery information, accepts these GTC, and proceeds to payment.

Payment is due immediately upon order. Payment is made securely by:

  • Bank card (via the Site's secure payment platform)

The order is firm and final upon confirmation of payment by the banking institution and the sending of an order confirmation email by The Chair Atelier.

Article 5 - Deliveries

Chairs are delivered to the delivery address indicated by the Client when placing their order.

  • Delivery times: Indicative preparation and shipping times are 7 to 15 working days (excluding weekends and public holidays).

  • Delivery areas: France, Belgium, Luxembourg.

The Client is responsible for checking the condition of the packaging and the goods upon delivery in the presence of the carrier. In the event of packages damaged during transport, the Client must absolutely refuse the package or make precise handwritten reservations on the delivery note, and inform the Seller within 48 hours by email.

Article 6 - Right of Withdrawal

In accordance with article L 221-18 of the Consumer Code, the customer has a period of 14 days from the receipt of their packages to exercise their right of withdrawal, without having to give reasons or pay penalties.

  • Terms: The Client must notify their decision to withdraw in writing to The Chair Atelier (by email).

  • Return costs: Return costs (often significant for bulky furniture such as chairs) are the sole responsibility of the Client.

  • Product condition: Products must be returned new, unassembled (if delivered as a kit), unused, and absolutely in their original packaging to avoid any breakage during return transport.

  • Refund: The seller will refund the customer for all sums paid (including standard initial delivery costs) within 14 days following the recovery and verification of the products.

Article 7 - Legal Guarantees

All chairs supplied by The Chair Atelier benefit by right from the legal guarantee of conformity (articles L. 217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code). In the event of a manufacturing defect or non-conformity, the Client may return the product for repair, exchange or refund.

Article 8 - Intellectual Property

The content of the site (the name The Chair Atelier, logos, texts, descriptions, graphic charters and photographs) is the exclusive property of the seller. Any reproduction, exploitation or use of the elements of the site, even partial, is strictly prohibited and may constitute an act of counterfeiting.

Article 9 - Personal Data (GDPR)

The Chair Atelier collects the client's personal data (name, address, email, phone) solely for the management and delivery of orders. This data is never sold to third parties. In accordance with the General Data Protection Regulation (GDPR), the client has a right to access, rectify and delete their data by writing to: contact@thechairatelier.com

Article 10 - Applicable Law and Disputes (Mediation)

These GTC are subject to French law. In the event of a dispute, the client will first contact the seller at the email address mentioned in Article 2 to agree on an amicable solution.

In accordance with the provisions of the Consumer Code, the client has the right to free recourse to a consumer mediator for the amicable resolution of the dispute. In the absence of an amicable agreement or mediation, the French courts shall have sole jurisdiction.
